The Prosecutor General K. Kozhamzharov initiated before the Supreme Court the termination of criminal cases against wrongfully convicted D. Myrzakulov and R. Gabdraufova.
In 2015, Myrzakulov was sentenced by al-Farabi District court of Shymkent city to 3 years 6 months in prison for theft on a large scale, as well as for attempted theft.
By results of studying of materials of criminal case by the Prosecutor General's Office it is established that the proofs which were in the case are forged, and the guilt wasn’t proved.
On October 16, 2018, the Supreme Court fully agreed with the arguments of the Prosecutor General and found Myrzakulov innocent.
This citizen illegally served for 3 years 2 months 20 days in the colony.
In 2016, Gabdraufova was convicted by Taraz city court for leaving the scene of a traffic accident and was sentenced to 1 year of restriction of freedom with deprivation of the right to drive a vehicle for a period of 1 year and 6 months.
According to 347 of the Criminal code, criminal liability for leaving the scene of an accident occurs in cases resulting in serious consequences.
In this case the victim had average injuries.
The Supreme Court granted the protest of the Prosecutor General and dismissed a lawsuit against Gadraufova due to the absence of structure of a criminal offense.
